摘要
经过汉初七十余年的文化复兴及文化整合,至西汉中期,儒家法律文化占据了法律文化的主导及主流地位,儒家法律文化深刻地影响了汉代法制的各个环节。儒家法律文化对汉代司法的影响主要表现在郡县官吏司法的儒家化方面。两汉郡县官吏在儒家伦理法观念、"无讼"观、"身正令行"观、德刑观及"恤刑"观的影响下形成了"春秋决狱"、综合治理、道德感化、调处息讼及"哀矜折狱"的司法之风。两汉郡县官吏司法的儒家化影响中国古代儒家化的司法传统及司法制度的形成。
After more than 70 years of revival culture and conformity culture in Han dynasty, in the Western Han Dynasty intermediate stage, the confucian law culture had occupied the legal culture leadership and the mainstream status, and profoundly affected Han Dynasty legal system. It＇s influence on the Han Dynasty judicature, mainly embodied in the prefectures and counties government official judieature＇s confucianism, influenced by the confucian ethics law idea, no -lawsuit view, the view that official set example, moral influence primarily, criminal law for auxiliary view and “pities the punishment”, they formed methods such as “Chun Qiu Statufe”, the comprehensive administration, and moral influence. Han Dynasty prefectures and counties government official＇s confucianism influenced China ancient time confucian judicial tradition and legal system.
