摘要
土地承包经营权流转方式主要包括转让、转包、出租、互换、入股和抵押六种。目前学术界和实践中对土地承包经营权流转各种主要方式之法律性质认识不一致,差异较大,不利于依法规范和正确实施土地承包经营权流转行为。为使土地承包经营权流转达到符合条件"自愿、规范、有序、依法"之客观要求,真正维护土地承包经营权流转双方的合法权益,对土地承包经营权流转各种主要方式之法律性质界定尤为重要。本文研究结论是:转让、互换和抵押属物权性的土地承包经营权流转;转包和出租属债权性的土地承包经营权流转;入股属股权性的土地承包经营权流转。
The transference of rural land contract and operation rights mostly includes transfer,subcontracting,hiring,exchanging,buy a share and mortgage.At present,the juristic character of main types of transference of rural land contract and operation rights in academe is different from the praxis.Thus,it makes against to let the behavior of the transference of rural land contract and operation rights to be legitimate,presentable and accurate.For letting the transference of rural land contract and operation rights to be 'conditional,voluntary,canonical,orderly and legitimate ' and sticking up for the two parties in the transference of rural land contract and operation rights,it is especially important to define the juristic character of main types of transference of rural land contract and operation rights.The conclusion of this study is: transfer,exchanging and mortgage belong to the nature of real rights;subcontracting and hiring belong to creditor's claim;buy a share belongs to creditor's claim.
