摘要
回顾改革开放30年以来中国从"法制"到"法治"的理论发展进程,着重阐述了邓小平依法治国的思想内涵和特征:社会主义的法治方向性、战略性,民主与法治的辩证统一以及法律至上性,提出继承和发展邓小平法治思想应当采取时代性与开放性、原则性与灵活性相统一的原则。
The paper looks back the theory developing process from “legal system” to “rule of law” since reform and opening up 30 years ago. Attention is concentrated on Deng Xiaoping＇s thoughts features governing the country by law, which include the direction of socialism, strategy, the dialectical unity between democracy and rule of law, as well as the supremacy of law. To inherit and develop Deng Xiaoping ＇s thoughts of ruling by law, the principle is to combine the times and openness with principle and flexibility.
