摘要
采用比较、分析和实证的方法,分析了我国未成年人刑事案件社会调查制度存在的主要的问题。针对问题,提出了应在检察机关的监督下,在侦查阶段,由独立的社会调查机构对所有的未成年犯罪嫌疑人启动社会调查程序。
The problems of social investigation system of Chinese juvenile are analyzed by ways of comparison, analysis and demonstration. In order to solve the problems, it advocates that an independent social organ should finish the social investigation procedure for all the juvenile suspects at the phase of investigation under the supervision of procuratorial organ.
