摘要
书记员制度改革是法院分类管理的重要步骤,但学界几乎没有人对这项改革进行反思,本文基于调查分析的基础上,对书记员制度的改革进行了全面反思。本文概述了书记员制度改革的背景,对具体的改革举措逐项进行评论,进而反思书记员制度改革存在的问题,并试图探寻其原因,最后对这项改革进行展望,指出其未来的发展方向。本文主张,对新进书记员实行单独序列管理,不再过渡为法官,并采用聘任制管理模式是不可能成功的,书记员制度改革应当符合中国国情,立足中国司法实践。
The revolution of clerks system is one of the most important steps of court classified management, However, there is no review for this revolution. The essay reviews the revolution of clerks system totally based on investigation and analysis. The essay introduces the background of the revolution of clerks system, then discusses this revolution, including comments, problems and their reasons, finally, the essay will give some suggestions for this revolution. The essay holds the opinion that for new clerks, it should use individual sequences management, they will no longer be the judges and appointment management mode will not successful. The revolution of clerks system should in line with the national conditions of China and also be based on judicial practice.
