摘要
结合我国物权法的实施,分析了以海岛使用权为核心的海岛权属问题;论证了我国以特殊用途海岛为标志的海岛分类保护与管理制度;并对我国海岛现行管理体制存在的一些问题进行分析并提出了完善建议。我国在海岛权属关系、海岛用途管理与级别保护以及海岛行政管理体制等方面存在的不足之处有待于在海岛立法中予以完善。
This paper, in combination with the enforcement of China＇s Real Law, analyzes the island ownership with which the usufruct of island is the central issue. It demonstrates the protecting and managerial systems of island classification, with the definition of specially used islands as the symbol of the system building. The evaluation and suggestion to perfect the existing island managerial system are also covered in this paper. The authors hold that China＇s deficiencies in clarifying the island ownership system, managing the usages of islands and protecting islands in accordance with the rating system of islands and the deficiencies in island administrative management system call for the perfection step by step in island legislation.
