摘要
随着司法改革的深入,程序正义的问题逐步成为国内理论界、实务界和普通民众关注的热点话题。程序正义,不仅限于在诉讼程序中实现正义,更重要的是凡是涉及程序的方面,都要求实现程序正义。本文试图从我国现行的环境法律制度的规定入手,并在环境民主原则的视角下,探索程序正义这种法律理念在环境法中的实现。
Along with judicial reform thorough, the procedure just question gradually becomes the hot spot topic which the domestic theorists, the practical realm and the ordinary populace pay attention. Procedure just, not only is restricted in the legal procedure the realization justice, more importantly every aspect that is involves the procedure, all requests to realize the procedure to be just. This article attempts from our country present environment law system stipulation to obtain, and in under environment principle of democracy angle of view, exploration procedure just this kind of law idea in environment law realization.
