摘要
个人信息保护立法的价值目标是多元化的,多元化的价值取向之间总是存在一定的冲突,其突出表现在个人信息保护立法的秩序和自由价值取向、秩序和正义价值取向、正义和效益价值取向之间的冲突等方面。为解决这一矛盾,本文提出了整合个人信息保护立法价值取向冲突的主要原则,即正义价值至上原则、兼顾原则和平衡原则。
Value orientation on the legislation of personal information protection should be muhiple, and different values always are in conflict with each other. The notable conflicts are the conflict between order of legislation on personal information protection and liberty value orientation, the conflict between order of legislation and justice value orientation and the conflict between justice and benefit valuation. The paper proposed the main principles that would coordinate the value orientation conflicts on legislation of personal information protection, i.e. the principle of the supremacy of justice valuation, the principles of compromise and the principles of balancing.
