摘要
赋予公立高等学校公法人中之特别法人的地位,是包括大陆法系国家与英美法系国家在内的共同特点和趋势。明确我国高等学校是公法人中的特别法人,既符合我国高等学校的现实,又与国际惯例和趋势相一致,是必要和有益的。
Vesting public institutions of higher learning （IHL） with the special legal status of public corporation is the common characteristic and tendency of countries adopting either the continental or the U.
