摘要
违法转租虽然未经出租人同意,但其属性是负担行为,在法律上是有效行为。其效力是出租人有终止租赁关系的解除权,并享有对承租人的不当得利请求权和损害赔偿请求权;次承租人可要求承租人赔偿其所受损失,并在其主观善意时,以其租赁权对抗出租人的返还租赁物和除去妨害请求权。
Although illegal sublease isn't authorized by the lessor, it is a valid behavior on the law and belongs to the verpflichtuyngeschaeft in nature. Its effect is that the lessor is entitled to terminate the lease relationship, to request the lease to return the unjust enrichment and to compensate his damaged lose; A sublease can request the lease to compensate his damaged lose, and have the power to resist the lessor's request to return with the leased property and request to eliminate harassment from the sublease.
