摘要
侦查人员是集多种角色于一身的人员。其中,国家利益的维护者与犯罪嫌疑人权益维护者、刑事追诉者与刑事辩护者、犯罪嫌疑人权益的限制者与犯罪嫌疑人权益的保障者、举证责任承担者与犯罪信息弱势者之间存在着角色的冲突。导致侦查主体角色冲突的原因,主要是因为侦查价值的多元追求、侦查主体的理性假设和侦查完善主义的期待。避免和化解冲突的方法是:角色的合理定位、部分角色的分化、角色之间的层次化以及加强角色的外部监督。
As an investigator who has some roles on himself, one the one hand, is the protector of both state interests and defender rights, on the other hand, is both of prosecutor and attorney, is both of police witness and weaker about criminal information, so on. There is a role conflicts on investigator. The reasons that lead up to this role conflicts on investigator are mainly the pluralistic values of investigative, rational presume of investigative subject and the perfect expect of investigation. The main ways of avoiding and eliminating the role conflicts may be： reasonable position of investigation role, differentiate of some roles, and stress the control over outside role.
