摘要
我国颁布的《物权法》(草案)没有关于空间权的规定,民商法学界关于空间权的研究也不多见。随着现代工业尤其是现代土木建筑技术的发展,土地的立体利用越来越普遍,有关空间利用纠纷也相应增加,对空间权进行物权法方面的研究也就成为法学工作者的一项重要任务。作者试图通过对空间权的法理、含义、性质、体系等方面的研究,以期达到抛砖引玉之效果。
Our country has promulgated a draft of ＂Law of Possession Right＂, in which there is no rule concerned with the spacial right. Similarly, the civil law and commercial law are also rarely concerned with this. With the development of modern industry, especially of modern civil engineering and architecture technology, it has become very popular to make solid use of land, from which many conflicts about the space arise. So it is very important for the law-making workers to research into the possession right about the space. This article just gives us a suggestion by way of discussing the space on the jurisprudence, connotation, nature and system.
