摘要
刑法表达技术不仅指刑法以恰当的语言文字、标点符号作为载体,由于其罪刑规范的特殊性,刑法的表达更突出逻辑严密性和庄重的修辞效果。刑法表达技术关系到刑事司法统一、刑法安定性、罪刑法定的实现及司法成本问题。刑法表达需协调好明确性与概括性、本土化术语与外来化术语、专业术语与大众术语、逻辑严谨与修辞艺术之间的关系。
The expression of criminal law depend not only on language, words and punctuations, but also on because of the particularity of its regulations, the criminal law should be more logical and more serious. Technique of criminal law expression is important to the realization of criminal justice unity, criminal law stability, the principle of a legally prescribed punishment for a specified crime, and the criminal justice cost. We should coordinate relations of explicitness and summarization, special technical terms and popular terms, logic seriousness and rhetoric art.
