摘要
美国反垄断立法虽然开创了其成文法的先河,但是其立法思想、基本原则和具体规则却具有深厚的普通法基础。通过对美国反垄断立法的普通法基础的考查,我们可以进一步挖掘法律运行的社会历史背景,这对中国当前进行的法治建设具有重要的理论指导意义和实践价值。
Although the antimonopoly law legislation of American is the harbinger of the American statute, but the deep-seated foundation of its idea, basic principle and special rules is the thought of common law. In this thesis, through reexamining the common law foundation of the American antimonopoly law legislation, the author researches the history social background of the law system more deeply so as to do some significant in theory and useful in practice for today＇s Chinese rule of law construction.
