美国的环境公民诉讼在立法和司法实践方面的发展道路相当曲折,法院对起诉资格的认定可作为一个晴雨表,反映了贯彻议会立法意图和维护传统司法精神的争斗。在这个过程中,环境公民诉讼进一步走向成熟。从美国联邦最高法院对环境公民诉讼起诉资格认定的变化中可以看出这一发展过程。
The road of development of Environmental citizen suit is a quite tortuous one in the US. The determination of the standing by the court serves as a barometer. Changes of flexible or restrictive controls reflect the struggles for carrying out the legislative intention and safeguarding the traditional judicial spirits. In this process, environmental citizen suit has developed step by step. From the changes of the US Federal Supreme Court＇ s determination of the environmental standing in environmental citizen suits, we can see this process of development.
