摘要
行政决策听证是行政机关在作出影响不确定对象利益的决定时,必须听取利害关系人意见的制度。我国最初的行政决策听证源于1998年施行的《价格法》的规定,随着《行政许可法》的颁布实施,不少地方都作出了行政决策听证制度安排。由于我国《行政程序法》的缺位,行政决策听证存在的缺陷是显而易见的。完善行政决策听证的路径依赖在于制度创新。
In China, administrative decision hearing system originated from the stipulations of" price law " executed in 1998, with " administrative regulation law " being promulgated and implemented, many governments had made the system arrangement of the administrative decision hearing. Because of lake of " administrative procedure law " in China, the flaw of administrative decision hearing is obvious. The path dependence for perfecting administrative decision hearing lies in the system innovation.
