摘要
目的探讨精神发育迟滞的涉案特征和临床特点。方法对近20年以来有关精神发育迟滞的司法鉴定资料,作综合分析。结果男女智能差异显著(p<0.01),男性以强奸54例(13.6%)、盗窃44例(11.1%)、抢劫20例(5%)、杀人35例(8 8%)为主,以轻一中度智能障碍患者多见,而女性主要是受性侵害后的性防卫能力鉴定,占所有女性鉴定案件的88.3%,其中未成年人占46.9%。结论精神发育迟滞的司法精神病学鉴定以刑事案件为主,民事案件呈上升趋势,男女智能水平案件的性质也明显不同。
Objective： To explore the clinical and forensic psychiatric characteristics of the mental retardation（ MR）. Methods： 397 fpatients with mental retardation in the 20 years（ 1984 -2004） recently were enrolled to analyze their demographic data, the characteristics of law eases, diagnoses and the results of responsibility. Results： There were significant differences in the levels of IQ（p 〈 0.01 ）between males and females, There were more rape cases54 （ 13.6% ） ,steal cases 44 （ 11. 1% ） ,homicide eases 35 （ 8.8% ） and robbery cases 20 （5%） in the male patients, the incidence rates was higher in the mild and moderate mental retardation patients than those in the severe degrees （p 〈 0.01 ） , but in the female the sexual violence weYe most in common, 88.3% were found in the women＇s cases . Conclusion： In recent 20 years the subjects of mental retardation in forensic psychiatrics appraisment practice were in the lower social class, unemployed and unmarried etc, they were younger than 35 , the most eases were the criminal ease, the civil cases were increased significantly （p 〈 0.01 ） and some criminal eases were decreased; The levels of IQ and characteristics of law cases were quite different between the sexes.
