摘要
1997年刑法第48条规定的“罪行极其严重”与“不是必须立即执行”是立法者为死缓适用设置的两个必要条件。从立法渊源来看,死缓条件的设置总体上体现了从严格到相对灵活、从具体到相对抽象的演变,从而为司法机关更好地贯彻死刑政策(特别是坚持少杀)留下较大的裁量空间。从政策依据来看,惩办与宽大相结合政策、死刑政策和国家尊重与保障人权政策为死缓制度的存在提供了基础。在规范含义上,应从社会危害性(包括客观危害和主观恶性)和人身危险性两个方面来理解“罪行极其严重”。从相关实证资料看,死缓适用条件的掌握不太统一,亟待最高人民法院加强死刑适用的统一。
“The crime committed is extremely serions”and “the immediate execution of a criminal punishable by death is not deemed necessary” regulated in Article 48 of 1997 Criminal Law are two essential conditions for the application of two-year suspension of execution of death penalty set up by legislative officer. According to the legislative resource, there are changes in the settlement of the conditions of death penalty with two-year snspension of execution, from strict conditions to more flexible conditions, so that more space of judgment can be left to he judiciary in implementing the death penalty policy, especially the policy of insisting on less death penalty. According to the basis of policy, the policy of combing punishment with lenience, the death penalty policy and the policy of human rights protection provide the basis for the two-year suspension of execution of death penalty. According to regulating the definition, we should understand “The crime committed is extremely serious” from two regards:degree of harm done to society(including objective harm and subjective danger) and personal danger degree of the criminal. We can find out from relevant materials, the application conditions of the death penalty with a suspension of execution are not unified. It is necessary and important for the Supreme People's Court to strengthen the unity of the application condition and standard.
