摘要
对贵州农村土地流转中产生的代耕与互换、出租与征用及土地流转合同效力纠纷进行类型化实证研究,认为缺失程序意识、流转主体特征与行政权力越位是纠纷的成因,提出强化土地普法、规范流转行为和平衡流转主体利益实现事前预防,及时调解与诉讼救济化解纠纷的对策,为"三农"决策提供参考。
The patterns of circulation dispute of rural land in Guizhou such as cultivation as agent and exchange,hire and requisition and effect of contract on land circulation were studied by authentic proofs.The contributing factor of these disputes consisted of the lack of consciousness of procedure,feature of circulation subject and offside of administrative power.Moreover,corresponding legal countermeasures were put forward including popularizing land law,standardizing circulation behaviors and balancing interes...
