摘要
职务行为与个人行为的划分直接影响国家赔偿责任的构成。为保护公民(相对人)起见,考虑我国执法现状及公民法律意识等因素,应将公民的主观认识与客观标准结合起来,并在特定的情况下以前者为准来界定职务行为。这是因为所谓的客观标准,说到底还是离不开人的主观识别。脱离主观去谈客观,就会使客观成为空中楼阁。惟有将二者结合起来,具体问题具体分析,方能找到界定职务行为的恰当标准。
Separation between act of duty and personal act influences the constitution of state liability for compensation. To protect the private party, we should combine subjective cognizance and objective standard, and define the act of duty with the former standard under special circumstance,because objective standard depends on subjective cognizance. Only if combine them can we find appropriate standard to define act of duty。
