摘要
测谎结论已经进入到我国司法领域,但对于测谎结论的属性还存在种种争议。测谎具有鉴定结论的所有特征,应当属于鉴定结论,并拥有鉴定结论的证据效力。但是由于测谎技术鉴定对象的特殊性,在适用测谎结论时不能等同于普通的物证鉴定,必须设定一些限制性规则,在发挥科技手段提高司法效率的同时兼顾保障被测人的合法权利。
The conclusion of lie-detection has entered the procedures of judicature in our country, but there is still controversy towards the nature of the lie-detecting conclusion. Lie detection has all the features of defining the conclusion. It belongs to the defining conclusion and owns the proof effect of defining conclusion. But, owing to the particularity of the defined subject by lie-detecting technology, it is not equal to the normal material definition when using the lie-detecting conclusion. It should be done to set up some restraint principles to ensure the legal right of the detected when increasing the judicatory efficiency in using the scientific means.
