摘要
本文分析一起经皮肝囊肿穿刺引流术后发生引流管断裂而造成的医疗纠纷。最终生产商赔偿原告 10万元 ,原告放弃对被告医院主张权利。解析本案 ,医院的医疗行为无过错 ,依法不应承担赔偿责任 ,发生断管的原因是由产品包装缺陷间接引起的 ,产品的生产者应承担赔偿责任 ,但医院实际上充当了销售者的角色 ,应为产品质量承担连带责任。通过专家点评 ,提出今后医、患。
This article analyzed a case of lawsuit caused by the rupture of catheter after percutaneous transcatheter drainage of liver cyst. As a result, the plaintiff agreed to drop all legal actions in consideration of a payment of $100 000 from the manufacturer of catheter (the plaintiff gave up the allegation to hospital),because the catheter was a deficient product. Actually, the manufacturer should respond in damages, the hospital had implicative liability because of acting as the device seller in this case.
