摘要
成年人监护是监护制度的重要组成部分,其监护的对象自二十世纪五十年代以来发生了很大的变化,以适应全球性高龄社会的到来。德国从成年人监护制度到照管制度的改革与发展正反映了这一时代要求。我国成年人监护制度法律规定较为简陋,且我国也正步入高龄社会,因此本文意图通过对德国监护制度改革与发展的介绍,为我国未来的监护立法提供参考。
The adult custody is a very important part of custody system. Since 1950s great changes in custody objects took place in order to adapt to the globally elderly society that is coming. The reform and development from adult custody to tending system in Germany is a reflection of the era’s demand.Because the rules of the adult custody system in China is quite simple, and China is stepping into an elderly society, this paper intends to provide a reference for the future custody legislation in China through the introduction of the reform and development of the custody system in Germany.
