摘要
本文探讨了债权转让的法律性质、构成要件、法律效力等基本问题,对理论与实践中突出的某些问题,如债权表见让与、债权让与抵销等进行了重点的阐述。从法学理论与司法实践的视角探析现行法律制度的缺陷,并提出解决的设想。
The article expounds the transfer of creditor's equity in terms of legal features, components and legal effectiveness. It elaborates the problems of transfer of creditor's equity sheet, transfer of creditor's equity and contra accounting. It points out the defects of current laws concerning transfer f creditor's equity and proposes countermeasures.
