摘要
欧盟对特许经营的规制,是从竞争法的角度出发的,它关注的焦点是特许经营合同有无限制竞争,或影响 成员国间贸易,而对于特许人与受许人之间的关系的调整,交由国内立法去完成。因此,有关特许经营立法当然构成 欧盟竞争法的一部分。本文介绍了有关欧盟特许经营立法的立法背景、立法改革,现行立法的主要内容,以及对特许 行业产生的影响,并希望其立法方法、立法内容对我国特许经营立法有一定的借鉴作用。
EU regulates franchising from angle of competition,which focuses on whether franchising contract hinders competition or trade between member states.Domestic legislation is responsible for the adjustment of relations between franchisor and franchisee.Therefore,legislation on franchising makes part of EU competition law.The essay introduces legislation background and its reform,content of present legislation and its impact upon franchise in EU.It hopes that its legislation pattern and content may provide some reference to Chinese franchising legislation.
