摘要
临床教学权利冲突本质上是一种利益冲突。权利冲突解决途径有二:立法和利益衡量,即建立健全临床教学立法体系,廓清权利的边界和范围,预防医患权利冲突的发生;通过司法手段就个案背后的利益冲突进行衡量取舍,化解临床教学纠纷。
In the article, the writer discusses the collisions, the central point of which is the collision of benefits, between the right to privacy of patients and the right of doctors clinical teaching, and hold that there are two solutions to the collision: legislation and the balancing of interest. First, a mechanism of legal guarantees should be set up to definitude legal status, right extent and responsibility of those engaged in clinical teaching. Second, the balancing of the interest should be use to settle the collision.
