摘要
BOT产生于 2 0世纪 80年代初期 ,是一种新型的利用国际私人资本进行基础设施项目的投资方式。这种投资方式解决了被投资国资金短缺的困难 ,更快、更好地解决了东道国的基础设施和福利问题 ,充分利用外资建设国家公共基础设施 ,促进了东道国国民经济的发展。在特许协议中 ,作为特许协议的一方当事人———政府和另一方当事人———私营企业之间的法律地位是平等的。政府在BOT中主要起到行政管理作用和保证作用。
BOT,as a new investment means,appears in the early of 1980’s.Through investing international and private capital in the foundation facilities,this kind of investment solves the problem of capital shortage in the invested country. In addition,it also solves the problems of foundation facilities and welfare in the host country smoothly. It makes full use of foreign capital to promote the host country’s economy development. In the concession agreement,government,as a party,has an equal legal status with the private enterprise (counter-part). Government mainly plays an administration and guarantee role.
