摘要
采用文献资料、文本分析、对比分析等方法,分析了足球伦理失范的主要表现及其社会危害性,对比分析了国外惩处足球问题的相关法律规制以及我国惩处足球问题的现行法治体系。研究表明,足球问题不仅破坏着公平竞争原则,影响中国足球水平提高和社会稳定,而且也影响着中国足球在国际体育界的形象,影响着中国在国际上的文明形象。加快构建预防与惩处足球问题的法治体系势在必行。建议:通过完善足球法制体系、健全足球管理体制和监督机制、加大对足球问题行为的处罚,着力预防与惩处足球问题,为我国足球发展提供强有力的法律保障和公正透明的法治环境。
By using the methods of literature,text analysis,comparative analysis,this paper analyses the embodiment of football ethical disorder and its harm to the society and compares and analyses the related judicial system to punish football ethical disorder in foreign countries and that in China.The research shows football ethical disorder not only destroys the fair competition principle,affects the improvement of the football industry in China and the social stability,but also affects the international sports image of the football industry in China as well as the international civilization image.As a consequence,it is highly necessary to accelerate the pace of the establishment of the judicial system to prevent and punish football ethical disorder.It is recommended to provide a solid and strong law guarantee and a fair and transparent judicial environment by perfecting the football judicial system,developing the football management system and inspection system,severely punishing and preventing football ethical disorder.
