摘要
自社区矫正作为刑罚执行制度在《刑法修正案(八)》中确立以来,社区矫正制度作为非监禁的刑罚执行方式占据重要地位,而在社区矫正确定前对其进行社会调查,已渐渐成为判决执行社区矫正的重要环节。现阶段,我国社区矫正调查程序已经在全国范围内开展,但是在社区矫正社会调查的实践中,存在诸多问题。本文从分析现状入手,剖析社区矫正社会调查中存在的问题,并提出相应的对策。
Since the community correction as a system in the"criminal law amendment (eight)"in the execution of punishment since its establishment, the community correction system as a non-custodial penalty implementation occupies is an important position, and in the community correction determination of the social investigation, has gradually become an important link in the execution of community correction.At present, China's community correction research program has been carried out throughout the country, but there are many problems in practice in the community correction social survey.This paper analyzed the present situation, analyzes the existing problems in the social investigation of community correction, and puts forward the corresponding countermeasures.
