摘要
显然马克思不是一位伦理学家,他对作为伦理核心的正义问题并没有系统性的论述和阐发.他不谈正义则已,一旦提到正义这一概念时,总离不开嘲讽(Spott) 或批判(Kritik).那么马克思何以对正义和权利有关的理论加以坚拒排斥呢? 主要的原因是他视这类问题属于意识形态的一部分,是他要摧陷廓清的对象.这些问题也牵涉着资产阶级的理念和制度,其虚伪性和欺瞒性正是马克思企图揭示暴露的.更何况他对日耳曼传统的法律哲学,特别是黑格尔的法哲学深感不满,有彻底厘清批判的必要. 尽管马克思不曾详尽阐述正义及其相关的问题,我们仍可以从他与其终身革命伙伴的恩格斯的浩瀚著作中,撷取他对正义、平等、公道的一些看法.
Marx's concept of justice is threefold. From the ethical point of view, he regardsjustice as a moral criterion which exalts goodness and condemns evil. In terms of law,he believes that justice is a juridical expression of the relations in social productionFinally, in his scientific analysis of the concrete society, Marx considers justice to bean inseparable part of the ideological superstructure.
