摘要
高丽律的亡佚给研究工作带来了巨大的障碍。本文在对现存高丽史料进行排比、分析的基础上,对高丽律进行了辑佚与复原。辑佚律文反映的是成宗制律之后,武人执政之前律典的情况。而复原律文反映的是武人执政以后修改过的律典的情况,对法典内容做了重大改动,故而与《刑法志》序言提示的结构不合。
The lost of Koryo Code made the research very difficult.On the basis of analysis of the existing historical materials of Koryo Dynasty,this paper collected and recovered some of regulations of Koryo Code.The regulations which had been collected reflected the law before the cavalier had began their rule.The regulations which had been recovered reflected the situation after the cavalier had began their rule.Because the cavaliers had revised the Code,the structure of the recovered Koryo Code didn' t comply with what had been recorded on the 'XingfaZhi' of 'Koryo history'.
