摘要
著作权集体管理制度是著作权制度的重要组成部分,是著作权制度发展到一定阶段的产物。当前,我国著作权法面临第三次修改,著作权集体管理以单节的形式被纳入修改草案中,其地位和重要性凸显。本文先从集体管理组织的概念和功能入手说明集体管理组织是什么,然后再从两大法系的角度简要的介绍了目前国外的著作权集体管理组织的概况并对其进行对比分析。最后对我国目前的五个集体管理组织发展进行概述,同时对国内的集体管理组织面临的问题和挑战做了归纳。以期能借鉴国外的成功经验来促进我国著作权集体管理组织相关立法和实践的发展和完善。
Copyright collective management system is an important part of the copyright system and is a certain product of copyright development. Currently,copyright law is facing the third revision and copyright collective management is included in the revised draft of the form of a single section,from which can see the status and importance of the highlights. This paper begins with the concept of collective management organizations in order to explain what the collective management organizations are. Then gives a brief introduction from the perspective of the two law systems to overview the foreign copyright collective management organization and comparative analysis them. Finally,we give an overview of our current five collective management organization development,and summarize the problems and challenges faced by the collective management organizations,hoping the learn from the successful experience abroad in order to promote the development and improvement of the legislation and practice of copyright collective management organization.
