摘要
社会主义市场经济法律制度是指社会主义市场经济严格按照体现人民意志、反映社会进步和客观经济规律的法律运作的法律制度。它的本质特征是法制的统一性、反垄断性、调控性和法律主体的自由性、平等性,这五点特征分别是由社会主义市场经济的统一性、竞争性、可控性、自由性和公正性决定的。它的内容包括确认市场主体资格、充分尊重和保护财产权、维护合同自由、国家对市场的适度干预和完善的社会保障等制度。它坚持财产所有权一体保护、合同自由、自己责任、公平竞争、经济民主、诚实信用、保护弱者、维护社会正义、市场交易顺利可靠安全、违法行为法定、经济管理权限和程序法定以及适当合理地兼顾国家、集体、个人、不同地区的利益等十二项原则。特别要加强社会主义市场经济法律制度的实施。
Legal institution under socialism economy is one that strictly embodies people's will, reflects social progress and the legal operation of the objective economic patterns. Its essential features are the unity, the anti-monopoly, the adjustment, the freedom and equality of the main body. These five features are decided by the unity, competition, adjustment,, freedom and justice respectively. Its content includes affirming the qualification of the market main body, respecting and protecting the property rights, maintaining the freedom of contracts etc- In addition, it also maintains the protection of the property right, the freedom of contracts self-responsibility, impartial competition, democracy of economy, honesty, etc. It's especially important to reinforce the implement of the legal institution under socialism marketing economy.
