摘要
船舶留置权的一个根本特征是占有是船舶留置权的成立和存续要件,随着我国民法中占有理论的不断发展,必然引起我国船舶留置权认识上的变化。本文试结合我国民法中的占有理论和相关法律规定,就占有对船舶留置权的影响进行分析研究,以求对船舶留置权的理解和行使从理论上找到根据。
The basic character of the possessory lien on vessel is that it is the obligee who holds the vessel agreed upon by a contract or provided for by Laws till the possession distinguished. This article analyzes the nature of the possession and its new development, and then discusses the possession's affecting on the validity of the possession lien on vessel based on the Maritime Code of P. R. C, the Security Law of P. R. C. and so on.
