摘要
公民私录视听资料是一种重要的诉讼证据,但我国现行立法对公民私录视听资料的法律性质欠缺准确界定,从而使私录视听资料的证明作用受到了限制。本文对当前私录视听资料的"合法性"做了一定的评价,从而认为对公民私录的视听资料审查应区别地承认其合法性。
The private audio-visual recording is an important litigation proof. But the legality of theprivate audio-visual recording is not clearly defined in the present legislation, thus restricting the proofing function of the private audio-visual recording.The paper presents some evaluation of the 'legality' of the private audio-visual recording and argues that the legality of the examination of the private audio-visual recording should be recognized on respective basis.
