摘要
同时履行抗辩权是合同制度的重要内容,在实践中应明析同时履行抗辩权与后履行抗辩权、不安抗辩权、留置权的区别;只要双方约定的时问相差不大的都可视为“同时履行”;还应本着诚实信用原则考虑同时履行抗辩权利行使的限制。
Simultaneously performing the right of demurrer is an important part in contract system. In practice, we should distinguish the simultaneous performance of demurrer right with after performance of it,etc. If the appointed time of both sides are almost the same,they could be regarded as'simultaneous performance'. We should take the limitations of performing the right of demurrer into consideration according to the principles of honesty and credit.
