摘要
行政人权利与权力的矛盾导致行政人的两种人格维度即权利人格与权力人格的矛盾冲突,具体表现为行政人权利人格与义务人格的冲突、行政人职权与其公民权的冲突。这种冲突会导致行政人员的行政行为与服务型政府建设目标相背离,因此必须进行调适。
The conflict between right and authority of administrative personality leads to the conflict of right-personality and authority-personality,which are two dimensions of administrative personality.Its concrete expression is the conflict between right-personality and duty-personality,and between authority of administrators and civil rights.This kind of conflict will result in administrators' deviating from the construction of service-oriented government,which,therefore,must be adjusted.
