摘要
我国军事司法机关是按照与普通司法机关类似的体系构建的,目前已经初具规模。但是,对军事司法权在概念上的梳理存在的缺失使得军事司法体制并不顺畅。合理地进行重构军事司法权,需要首先澄清基本概念,并在此基础上,通过诉讼法和组织法的修改,逐步建造起兼顾司法规律和军队特色的军事司法制度。
China s military judicial system has been built in accordance with the common judicial system.However,some misunderstandings of the concepts of military system still exist.In order to rebuild the system reasonably,those concepts must be clarified at first.On this basis,through the amendment of criminal procedural law and organic law,a military system fitting with both judicial rule and armed forces will emerge.
