摘要
诱惑侦查制度作为对付新型犯罪的有利武器为世界各国刑事立法所确认,作为大陆法系代表的德国其诱惑侦查制度有其自身的特色,其诱惑侦查的适用界限、法制控制、秘密证人作证制度等对我国相关制度的建立具有一定借鉴价值。诱惑侦查在实践中广泛存在,但并没有相应制度上的规定。为解决这一实践和制度的脱节,通过对德国诱惑侦查制度中认可诱惑侦查合法性的审慎态度、法制控制、适用要求以及秘密证人作证制度的分析,可以为我国诱惑侦查制度的构建与完善提出可行的建议。
