摘要
研究目的:全面了解香港土地法律制度,为大陆土地法律制度的设计提供建议。研究方法:对香港土地法律体系全面研读,并对其具体内容进行归纳总结。研究结果:香港土地法律体系具体内容分为两部分:一部分为香港岛及南九龙土地法律体系,主要从土地、房屋及城市规划三方面来介绍其法律条文;另一部分为新界地区土地法律体系,由于历史原因除上述一般法律条文外,新界地区还形成了一些特殊的法律条文。通过对香港土地法律体系的研究,对大陆土地法律的制定、修改、执行三方面给予了建议。
The purpose of this paper is to comprehensively understand the land law system of Hong Kong and provide suggestions on the design of land law system in mainland of China.Method of comprehensive study was employed.The result show that the land law system in Hong Kong is divided into two parts: one part is the land law system of Hong Kong Island and Southern Kowloon,mainly introducing the content from land,housing and urban planning;one part is the land law system of New Territories which has some special leg...
