摘要
为了适应农村土地制度改革法制化要求,解决土地承包经营制度实施20多年后面临的新问题,从根本上实现“三农”问题的解决,保障农民权益,必须进一步改革和完善农村土地承包经营制度。文章从土地承包经营权入手,分析了土地承包立法面临的若干问题,提出明确土地承包经营权的物权化性质,以“公平优先、兼顾效率”为立法原则,赋予农民真正有保障的土地权利等建议。
