摘要
刑事被害人国家补偿制度对于实现刑事法律价值,促进社会公平与正义,提高惩治和预防犯罪效能,完善刑事司法制度以及实现构建和谐社会的远大目标,具有非常大的意义。我国拥有庞大的被害人群体,他们从犯罪人和其他渠道获得的赔偿极不充分,应享受的社会公平正义得不到实现,有可能对社会秩序构成潜在威胁,我国亟需建立被害人国家补偿制度。
The governmental compensation system for victims of crime gives certain compensations to those victims who have suffered from the crime but can’t get sufficient compensation from the criminal or other sources.The system is significant to realize the value of criminal law;promote social justice and equity;improve the efficiency of criminal law to punish and prevent the crime;perfect the criminal judicial system and constructing the harmonic society.There are a large number of victims of crimes in our country and the compensation from the criminals and other sources is very insufficient.To carry out the social justice and equity,and also to prevent the potential threaten of disappointed victims to the society,it is necessary for our country to set up the governmental compensation system.
