摘要
                
                    交结近侍官员是明代创设的罪名,属于奸党罪中一条。从罪名来看,律文具有打击结伙犯罪的特性,与令、诰、祖训、榜文、诏敕、问刑条例、条法事类等共同构成严密的法规体系。该罪名上承"十恶"重罪,下统各类职官结伙犯罪,成为弹性极大、包容性极强的"口袋罪"。皇恩眷顾是人情、君尊臣卑是天理、罪名适用是国法,交结近侍官员的罪名设定,推动了中华法系"情、理、法"文明的升华,承载传统政治纲常伦理道德精髓,反映出君主专制制度发展到顶峰时期的罪名构建特征。
                
                "Associating with court attendant officials"was a criminal conduct proscribed by law in the Ming dynasty(1368-1644).It belongs to the category of"the offence of evil faction".Judging from its specific name,the code of the crime is targeted to punish gang crime,and constitutes a close-knit system of laws with order,admonition,ancestral instruction,public notice,decree,penalty bylaw,and other legislative rules.The crime is so accommodative that it could be applied to both the severe crime as one of the"Ten Hideous Guilty"and minor offenses related to misconducts by a gang of officials at all levels.A pardon from the emperor was out of sympathy;the obedience of officials to the monarch was social norm;the application of a criminal law was legislative procedure.The establishment of the crime"associating court attendant officials"prompted the elevation of the civilization of China’s legal system–the integration of sympathy,rationality,and law,which continues the essence of traditional political ethical codes and moral principles,and reflects the characteristics for establishing criminal offenses at the acme of China’s autocracy society.
