摘要
在国际贸易领域,指责中国不遵守世贸组织规则的声音不绝于耳。世贸组织成员是否遵守了世贸组织规则,一个重要的检验标准在于该成员对世贸组织裁决的执行。本文将从执行时间及执行质量两方面,比较中国的执行状况与美国、欧盟、印度、巴西等世贸组织成员执行状况的差异。本文认为,国际社会结构的特殊性,世贸组织作为国际法治典范的不足及裁决本身存在的问题,导致世贸组织成员难以完全执行所有裁决。鉴于此,中国虽同其他国家一样无法完全执行所有的裁决,但在总体上,不管是同作为发达国家或地区代表的美国及欧盟相比较,还是同作为发展中国家的印度与巴西相对比,中国执行裁决的表现都极为出色。这充分体现了中国对世贸组织规则的尊重,展现了中国对维护世贸组织法治化所作出的贡献。
In the field of international trade,accusations against China’s non-compliance with WTO rules are endless.One test of whether a WTO member has complied with WTO rules is the implementation of WTO rulings by the member.This paper will compare the compliance status of China with the compliance status of WTO members such as the United States,the European Union,India,and Brazil,from the aspects of timeliness and quality of compliance actions.This paper argues that the particularity of the structure of the international community,the inadequacy of the WTO as a model of international rule of law,and the problems with the rulings themselves make it difficult for WTO members to fully comply with all rulings.In view of this,although China,like other WTO members,is unable to fully comply with all the rulings,in general,whether it is compared with the United States and the European Union,which are representatives of developed countries or regions,or India and Brazil,which are developing countries,China’s compliance with the rulings has been excellent.This fully reflects China’s respect for WTO rules and its contribution to safeguarding the rule of law of WTO.
