摘要
美国是世界上较早建立较完整的自然资源损害评估与修复体系的国家。本文通过梳理美国官方网站和法律条款相关信息,得出以下结论:美国的自然资源损害评估体系主要由内政部、商务部、农业部等部门和各联邦州共同组成,评估工作主要由四部分组成,涉及的法律主要有《综合环境反应、赔偿和责任法》(CERCLA)、《清洁水法》(CWA)和《石油污染法》(OPA),评估资金来源于国会拨款和赔偿费用,修复费用来源于责任方赔偿。
The United States is one of the earliest countries in the world to establish a relatively complete system of natural resources damage assessment and remediation.By combing the official websites and legal provisions of the United States,this paper draws the conclusions.Natural resource damage assessment and remediation is mainly composed of the Department of the interior,the Department of Commerce,the Department of agriculture and state governments.The assessment process in the United States consists of four parts,and the laws involved CERCLA,CWA and OPA.The assessment is funded by national appropriations and compensation costs,and the remediation costs are funded by compensation from the responsible party.
