摘要
党内法规的司法适用作为人民法院根据法定职权和法定程序,将党内法规运用于审判过程的专门活动,是深入推进中国特色社会主义法治体系建设的重要内容。通过对中国裁判文书网上2013至2021年涉及党内法规适用的304份裁判文书的案件类型、法院层级、时间地域等基本情况和诉讼程序、提供主体、适用目的、法院态度等程序方法进行统计分析,发现在不同类型、不同层级、不同年份、不同地域的案件审理过程中,党内法规在司法裁判中并未受到排斥,但不同主体对待党内法规司法适用的态度有较大差异。这说明党内法规作为裁判依据融入司法将是一个长期过程,既要从法理上正确认知党内法规的司法适用,又要通过选取准则实现有效识别,并建立案例类型图谱来严格规范。
The judicial application of intraparty rules and regulations,as a special activity of the people’s court to apply intraparty rules and regulations to the judicial trial process according to the statutory functions and powers and legal procedures,is an important part of deepening the construction of the socialist rule of law system with Chinese characteristics.Based on the statistical analysis of the basic information of the case type,court level,time and region of 304 judicial documents related to the application of intraparty rules and regulations in China’s online judicial documents from 2013 to 2021,as well as procedural methods such as litigation procedure,provider,purpose of application,and court attitude,it is found that in the process of trial of cases of different types,levels,years,and regions,intraparty rules and regulations are not excluded in judicial adjudications,However,different subjects have different attitudes towards the judicial application of intraparty rules and regulations.This shows that it will be a long-term process for the intraparty rules and regulations to be incorporated into the judiciary as the basis for judgment.We should not only rationally understand the judicial application of intraparty rules and regulations,but also use effective identification and establishment of case type atlas to strictly regulate the judicial application of intraparty rules and regulations.
