摘要
数字技术伴生的商业模式演化,给反垄断执法带来挑战的同时,也促进了全球反垄断监管科技的发展。部分国家和国际组织近年加大反垄断监管科技的调研力度,斯坦福大学的“计算反垄断”项目更是吸引了全球60多个国家、地区的反垄断执法部门参与,体现了各国的高度重视。当前全球主要反垄断辖区的监管科技应用,体现了融合计算科技的大趋势。针对卡特尔的自动化检测工具是当前各国最为重视的领域,经营者集中领域监管科技的适用尚处于起步阶段,聚焦滥用市场支配地位方面的监管科技各国则鲜有涉及。影响当前各国反垄断监管科技进一步发展的重要问题包括机构设计、数据支撑、技术局限以及公众信任等方面。为提升我国反垄断智慧监管水平,执法部门应深化理论研究、重视数据积累、侧重特定行为,并关注国际发展。
The evolution of business models,motivated by digital technologies,not only poses challenges to antitrust enforcement,but also promotes the development of science and technology(S&T)with respect to global antitrust regulation.In recent years,some countries and international organizations have intensified the research into antitrust regulatory S&.T.Taking the Stanford University's“Computational Antitrust”project as an example,it has attracted participation of antitrust enforcement agencies from over 60 countries and regions worldwide,reflecting the high attention paid by relevant stakeholders.The nowadays application of regulatory S&T by major antitrust jurisdictions around the world embodies the general trend of computational S&T integration.Antitrust enforcement agencies have paid most attention to automated detection tools to fight against cartels,which are followed by merger control,to which the application of regulatory S&T is in its infancy.Regulatory S&T against abuse of dominant market position has been rarely discussed about.Key issues obstructing the further development of antitrust regulatory S&T include institutional design,data support,technology limitation,and public trust,among others.To improve China's intelligent antitrust regulation,law enforcement agencies should deepen theoretical research,value data accumulation,prioritize certain behaviors,and pay attention to international development.
