摘要
我国社会信用立法一般采取“地方先行试点”模式。在国家相关立法正式启动前,已有不少地方先行先试,制定了社会信用地方性法规。这种情况下对当前部分社会信用地方性法规进行梳理与总结,检视其问题与不足,提出构建完善社会信用地方先行立法的应然路径,不仅对完善信用地方立法、实现社会信用规范化、法治化意义重大,而且也为我国下一步出台统一的社会信用立法提供了有益的经验积累。
China’s social credit legislation generally adopts the"Local prior pilot projects"model.Prior to the official launch of relevant national legislation,many localities have already made trials and formulated local laws and regulations on social credit.In this case,this paper sorts out and summarizes some of the current local laws and regulations on social credit,examines their problems and deficiencies,and proposes a path to build and improve local legislation on social credit,which not only makes a deference to the improvement of local legislation on credit,and the realization of the standardization and legalization of social credit,but also provides a useful accumulation of experience for the next step of China’s promulgation of unified social credit legislation.
