摘要
控辩审关系研究是中国刑事庭审话语研究的热点,但先前研究主要集中于语言层面。本文在社会符号学的视域下,构建基于价值协商的控辩审关系多模态分析框架,从多模态资源的框定、选择、前景化及配置等维度探索控辩审关系建构中价值协商的话语资源。该框架有利于运用多维度的研究方法(如微观与宏观、共时与历时、定性与定量等),系统考察庭审互动中控辩审三方如何调用多模态资源,构建群内、群外身份并建构各方关系,从话语视角关注庭审中的控辩审关系,拓宽控辩审话语研究的维度和广度,促进数字时代的法治政府建设。
The discursive construction of the prosecution-defense-judge relationship has been a central concern of the discourse study of Chinese criminal courtroom trials.However,the previous research mainly focuses on the level of language.From the perspective of social semiotics,this paper proposes an analytical framework for exploring the multimodal discursive construction of the prosecution-defense-judge relationship from the dimensions of multimodal framing,selection,foregrounding and arrangement.It also shows how multiple complementary research methods(e.g.micro-scope and macro-scope,synchronic and diachronic,qualitative and quantitative)can be integrated to systematically explore the multimodal construction of their identities and the establishment of their in-group and out-group relationships during courtroom interaction.This study may shed light on the research of the prosecution-defense-judge relationship,thus promoting the development of a rule of law government in this digital era.
