摘要
中韩黄海渔业争端呈现愈演愈烈的现象,暴力伤亡事件时有发生。中国渔民的“非法捕捞”和韩国海警的暴力执法只是表面的原因,探究中韩黄海渔业争端的根本原因是两国之间专属经济区的划分迟迟未定。《中韩渔业协定》区域划分的不公在一定程度上又加深了两国之间的矛盾,同时韩国国内媒体的恶意报道和高压政策对解决中韩黄海渔业争端问题起到了消极作用。为加强两国的渔业合作和提升国际关系,解决黄海争端迫在眉睫,需要两国加强沟通交流,对《中韩渔业协定》进行修改,同时完善我国的国内立法,积极携手韩国打造共同海上执法队伍,才是适当的解决之道。
The fishery dispute between China and Republic of Korea(hereinafter refers as ROK)in the Yellow Sea is becoming more and more intense.Illegal fishing by Chinese fishermen and violent law enforcement activities conducted by the Coast Guard of ROK are only superficial reasons.The root caused of the Yellow Sea fishery disputes between China and ROK is due to the division of the exclusive economic zone between the two countries.has been uncertain.The unfair regional division of the China-Rok fishery agreement,to some extent,further deepens the contradiction between the two countries.At the same time,domestic media reports in ROK have infused a negative impact on the matters.In order to strengthen fishery cooperation between the two countries and enhance bilateral cooperation,it is urgent to solve the Yellow Sea fishery dispute.It is necessary for the two countries to strengthen communication and exchanges,revise the China-Rok Fishery Agreement.It would also helpful to revise the relevant Chinese domestic legislation,and actively works with Rok in order to build a joint maritime law enforcement team.
